Working Week The standard working week applying to the whole time equivalent of this post is: 35 hours. Annual Leave The annual leave associated with the whole time equivalent of this post is 30 days per annum. Superannuation This is a pensionable position with Tusla. The successful candidate will upon appointment become a member of the appropriate pension scheme. Pension scheme membership will be notified within the contract of employment. Probation A probation period of 39 weeks, or proportion of same for fixed term /specified purpose contracts, where applicable shall apply from the commencement of employment, during which the contract may be terminated by either party in accordance with this contract. The probationary period may be extended at the discretion of management by a further 9 weeks or proportion of same for fixed term/specified purpose contracts, where applicable. Confirmation of appointment as a permanent member of staff is subject to the successful completion of the probationary period, for permanent contracts. JOB DESCRIPTION Applications are invited from suitably qualified persons for inclusion on a panel from which temporary (1 year) vacancies for the position of Dog Warden with Offaly County Council shall be filled.   The Dog Warden shall give priority at all times to the welfare of the dogs in their care and so a satisfactory knowledge and/or experience in animal husbandry is essential.   The successful candidate will require excellent customer service skills as engagement with the public will be a feature of the position.   The successful candidate will have excellent written and verbal communication and report writing skills and will be required to be a witness on behalf of Offaly County Council in courts of competent jurisdiction.   The position of Dog Warden will require flexibility and will include a mix of administration and manual duties.   The successful candidate will require the ability to work across different sections of Offaly County Council and develop close cooperation with local stakeholders and; a)      such other local authorities or bodies for which the Chief Executive, for the purposes of the City and County Management Acts, is Chief Executive; and b)     to any other local authority or body with which an agreement has been made by the local authority or by any of the authorities or bodies mentioned in sub-paragraph (a) of this paragraph, under the direction and supervision of the appropriate Director of Services or any other officer designated by him/her, such services as may be required by any local authority or body herein before mentioned in the exercise and performance of any of its powers, functions and duties. The holder of the post will perform duties as may be assigned from time to time, on a county-wide remit, to ensure the Offaly County Council complies with all statutory obligations and regulations.   They shall work in close liaison with An Garda Siochana, the Department of Agriculture, Food and the Marine, other local authorities, and registered animal welfare charities, and shall direct and co-operate with such organisation(s). For the above reasons, but not limited to the above, they shall take all reasonable steps to ensure flexibility and that they can be contacted by the above, when required, through agreed protocols and procedures.   The Dog Warden will receive, and investigate fully, complaints relating to breaches of various legislation and bye-laws that are applicable to the role. The Dog Warden will produce verbal and written reports on their investigations. All evidence will be treated in the strictest confidence.   The warden will arrange, issue, and serve any necessary statutory notices. Where a particular course of action is determined the warden will be expected to follow that course of action to completion.   The Dog Warden will make contemporaneous notes on their investigations. The Dog Warden will be required to deliver evidence in a relevant court as required. Duties & Responsibilities   The duties of the post of the Dog Warden include, but are not limited to:   ·         Issue of Fixed Penalty Notices under the Control of Dogs Act 1986 (as amended); ·         Seize dogs under the Control of Dogs Act, 1986, (as amended) and the Animal Health and Welfare, 2013 Act (as amended), when necessary; ·         Assist An Garda Siochana in their duties with regard to managing dogs defined as dangerous breeds; ·         Assist An Garda Siochana with Dog Control during their planned operations ·         Prepare the necessary reports and attend court as necessary to present evidence on behalf of Offaly County Council in prosecution of animal welfare case, non-compliance with animal control requirements cases, or Dog Breeding Establishment cases as required; ·         Investigate complaints from the public and the Gardai in relation to dogs; ·         Remove or arrange for removal of animal carcases from public places including beaches; ·         Work in close co-operation with Gardai in relation to matters pertaining to control of other animals in public places; ·         To keep record of times on duty each week; ·         Record each attendance at the pound/ kennels; ·         Maintain a record of any payments received and submit same to the Council; ·         Investigate complaints in relation to stray and unlicenced animals; ·         Carrying out Dog Licence Inspection Patrols; ·         Investigate cases of unburied animal carcasses under the Control of Dogs Act; ·         Investigate complaints regarding stray horses and enforce the Control of Horses legislation (including outside of normal hours if necessary); ·         To attend such training courses as and when required; ·         Driving the Council’s collection vehicle and taking care of routine maintenance, for example- daily walk around checks, daily SSWP water level, oil level, battery level and ensuring the vehicle is serviced regularly, cleaning the vehicle both internally and externally on a weekly basis; ·         Perform duties in accordance with the Council’s Health and Safety policies including operating in accordance with the relevant Risk Assessments and SSWP ·         To perform all duties associated with the implementation of the Control of Dogs Act 1986 and amendments and regulations thereafter ·         To perform all duties associated with the implementation of the Control of Dogs (XL Bully) Regulations 2024 (as amended); ·         To perform all duties associated with the implementation of the Animal Health and Welfare Act, 2013 (as amended); ·         To perform all duties associated with the implementation of the Dog Breeding Establishments Act, 2010 (as amended); ·         Subject to direction, when requested, issue media publicity on the welfare of dogs and assist in the implementation of relevant educational programmes; ·         Abide by the Council's financial procedure as instructed; ·         Regular co-operation and good working relationships with personnel from animal shelter facilities, animal welfare organisations and other parties; ·         Regular visible patrols of public areas and open spaces to proactively monitor compliance with animal control legislation; ·         Attendance at planned community events and participation in promotional activities to increase general public awareness of Animal Welfare & Control Services ·         The Dog Warden shall be available for emergencies which may arise outside normal working hours; ·         The Council may, from time to time, assign such duties as may be considered necessary to properly discharge the Council’s responsibility under relevant Acts, Bye Laws. A panel will be formed for an initial period of one year and this may be extended for a further year at the discretion of the Chief Executive. The panel will be used to fill temporary positions that may arise for its duration. Vacancies will be offered in order of merit as per the panel.   2.      Salary: The salary shall be fully inclusive and shall be as determined from time to time.  Holders of the post will be paid at the appropriate point on the salary scale in accordance with the relevant Department Circular.     The current salary scale applicable to the post is €834.90 - €901.81 per week   3.      Duties: The duties of the post are to give to the local authority, and a)      such other local authorities or bodies for which the Chief Executive, for the purposes of the Local Government Acts 2001 and 2014, is Chief Executive, and   b)     to any other local authority or body with which an agreement has been made by the local authority, or by any of the authorities or bodies mentioned in subparagraph (a) of this paragraph under the general direction and supervision of the Chief executive or such other employee as the Chief Executive may from time to time determine, such appropriate services of an executive, administrative or management nature as may be required by any local authority or body herein before mentioned in the exercise and performance of any of its powers, functions and duties to exercise such powers, functions and duties as may be delegated to him/her by the Chief Executive from time to time, including the duty of servicing all committees that may be established by any such local authority or body. You may be requested in certain circumstances to work overtime and time off in lieu will be applicable. The working hours may be reviewed at any time by the Council.   7.      Annual Leave: The current annual leave entitlement is 25 days inclusive of Good Friday. Granting of annual leave, payment for annual leave and arrangement for public holidays will be governed by the provisions of the Organisation of Working Time Act, 1997 (as amended)   8.      Sick Leave: The terms of the Public Service Sick Pay Scheme will prevail.   9.      Superannuation: Public Service Pensions (Single Scheme and Other Provisions) Act 2012 : New members joining the Public Sector on or after 1st January, 2013 will be required to join the Single Public Service Pension Scheme. The Single Scheme applies to all pensionable first-time entrants to the Public Service as well as to former public servants returning to the public service after a break of more than 26 weeks. A rate of PRSI contribution will be required of their superannuation to contribute to the local authority at the rate of 3% of their pensionable remuneration plus 3.5%, of net pensionable remuneration (i.e. pensionable remuneration less twice the annual rate of social insurance old age contributory pension payable at the maximum rate to a person with no adult dependant or qualified children). This includes a contribution to a Spouse’s and Children’s Scheme. Pension and retirement lump sum based on career-average pay pensions will be co-ordinated with the State Pension Contributory (SPC).   For persons who commenced public sector employment prior to 1st January 2013: Persons who become pensionable employees of a local authority who are liable to pay the Class A rate of PRSI contribution will be required in respect of their superannuation to contribute to the local authority at the rate of 1.5% of their pensionable remuneration plus 3.5% of net pensionable remuneration (ie. pensionable remuneration less twice the annual rate of social insurance old age contributory pension payable at the maximum rate to a person with no adult dependant or qualified children).   Persons who become pensionable employees of a local authority who are liable to pay the Class D rate of PRSI contribution will be required in respect of their superannuation to contribute to the local authority at the rate of 5% of their pensionable remuneration.   All persons who become pensionable employees of a local authority will be required in respect of the Local Government (Spouses and Childrens Contributory Pension) Scheme to contribute to the local authority at the rate of 1.5% of their pensionable remuneration in accordance with the terms of the scheme.     10.  Retirement: Public Service Pensions (Single Scheme and Other Provisions) Act 2012: The compulsory retirement age for new entrants as defined by the Public Service Pensions (Single Scheme and Other Provisions) Act 2012 is 70 years. Minimum pension age of 66 years, rising to 67 years and 68 years in line with State Pension age changes, is applicable.   Public Service Superannuation (Miscellaneous Provisions) Act, 2004: There is no mandatory retirement age for ‘New Entrants’ from 1st April, 2004 to the public service as defined in the Public Service Superannuation (Miscellaneous Provisions) Act 2004. 65 years is the minimum age at which a person may be paid. As a new entrant to the public service, under the terms of this legislation, new entrants will not be required to retire on grounds of age.   Anyone who is not a ‘New Entrant’ to the public service, defined in the Public Service Superannuation (Miscellaneous Provisions) Act 2004 is subject to compulsory retirement age of 65 years. 11.  Travel: When required to do so, holders of the post shall hold a full driving licence for class B vehicles and shall drive a motor car in the course of their duties and for this purpose, provide and maintain a car to the satisfaction of the local authority. If you are required to travel as part of your official duties, Offaly County Council as your employer must be indemnified on your insurance policy. Travelling expenses and subsistence expenses necessarily incurred in the course of official duties will be refunded in accordance with appropriate rates in line with the relevant Department Circulars and Offaly County Council’s Travel and Subsistence Policy. If during your employment, your licence is revoked, even temporarily, or if you receive endorsements on your licence, which may affect your duties, you are obliged to notify the Council immediately.   12.  Recruitment & Selection Process: Shortlisting: Normally the number of applications received for a position exceeds that required to fill existing and future vacancies to the position. While a candidate may meet the eligibility requirements of the competition, if the numbers applying for the position are such that it would not be practical to interview everyone, Offaly County Council may decide that a number only will be invited to same. In this respect, Offaly County Council provide for the employment of a short listing process to select a group for interview who, based on an examination of the application forms, appear to be the most suitable for the position based on the specific competencies identified in the job description. An expert board will examine the application forms against a pre-determined criteria based on the requirements of the position. This is not to suggest that other candidates are necessarily unsuitable or incapable of undertaking the job, rather that there are some candidates, who based on their application, appear to be better qualified and/or have more relevant experience. It is therefore in your own interest to provide a detailed and accurate account of your relevant qualifications/ experience on the application form. The Office of Public Works (OPW) invites applications for positions in the grade of General Operative Band 3 (Rural) in the OPW’s East Region Arterial Drainage Maintenance and Construction Services Division. OPW Areas of Responsibility • The OPW’s areas of responsibility include Heritage Services and Flood Risk Management. • As the lead agency for flood risk management in Ireland, the OPW is responsible for the maintenance of schemes completed under the Arterial Drainage Acts 1945 & 1995, and the Coast Protection Act 1963; and the construction of flood relief schemes under the Arterial Drainage Acts 1945 & 1995, and the Planning Acts in partnership with the relevant Local Authorities. Collective Agreement: Redundancy Payments to Public Servants • The Department of Public Expenditure and Reform letter dated 28th June 2012 to Personnel Officers introduced, with effect from 1st June 2012, a Collective Agreement which had been reached between the Department of Public Expenditure and Reform and the Public Services Committee of the ICTU in relation to ex-gratia Redundancy Payments to Public Servants. • It is a condition of the Collective Agreement that persons availing of the agreement will not be eligible for re-employment in the Public Service by any Public Service body (as defined by the Financial Emergency Measures in the Public Interest Acts 2009 – 2011) for a period of 2 years from termination of the employment. • People who availed of this scheme and who may be successful in this competition will have to prove their eligibility (expiry of period of non-eligibility). Incentivised Scheme for Early Retirement (ISER) • It is a condition of the Incentivised Scheme for Early Retirement (ISER) as set out in Department of Finance Circular 12/09 that retirees under that Scheme, are not eligible to apply for another position in the same employment or the same sector. • Therefore, such retirees may not apply for this position. Department of Health and Children Circular (7/2010) • The Department of Health Circular 7/2010 dated 1 November 2010 introduced a Targeted Voluntary Early Retirement (VER) Scheme and Voluntary Redundancy Schemes (VRS). • It is a condition of the VER scheme that persons availing of the scheme will not be eligible for reemployment in the public health sector or in the wider Public Service or in a body wholly or mainly funded from public moneys. • The same prohibition on re-employment applies under the VRS, except that the prohibition is for a period of 7 years. • People who availed of the VER scheme are not eligible to compete in this competition. • People who availed of the VRS scheme and who may be successful in this competition will have to prove their eligibility (expiry of period of noneligibility). Department of Environment, Community & Local Government (Circular Letter LG (P) 06/2013) • The Department of Environment, Community & Local Government Circular Letter LG (P) 06/2013 introduced a Voluntary Redundancy Scheme for Local Authorities. • In accordance with the terms of the Collective Agreement: Redundancy Payments to Public Servants dated 28 June 2012 as detailed above, it is a specific condition of that VER Scheme that persons will not be eligible for reemployment in any Public Service body [as defined by the Financial Emergency Measures in the Public Interest Acts 2009 – 2011 and the Public Service Pensions (Single Scheme and Other Provisions) Act 2012] for a period of 2 years from their date of departure under this Scheme. • These conditions also apply in the case of engagement/employment on a contract for service basis (either as a contractor or as an employee of a contractor). Age • On the closing date for receipt of applications for this position, the following are the eligibility requirements with regard to age: • the minimum age requirement for potential applicants is 18. • the appointee will be a member of the Single Public Service Pension Scheme, as defined in the Public Service Pensions (Single Scheme and Other Provisions) Act 2012. Under the Scheme, retirement is compulsory on reaching 70 years of age. Outside Employment • The position is whole time and the officer may not engage in private practice or be connected with any outside business, which would interfere or conflict with the performance of official duties. • Clarification must be sought from line management where any doubt arises. • If, following appointment, the appointee is or intends to be engaged in or connected with any outside business or employment, the appointee is obliged to inform OPW HR Management (Operational) Division of such an intention. Ill-Health Retirement • For an individual who has retired from a Civil/Public service body on the grounds of ill-health his/her pension from that employment may be subject to review in accordance with the rules of ill-health retirement within the pension scheme of that employment.
