The Assistant Scientist will work as part of multi-disciplinary teams within the Environment Department of Offaly County Council. The role requires comprehensive knowledge and understanding of the Waste Management Act 1996, as amended, and the Local Government (Water Pollution) Act 1977-1990, as amended, and the associated enforcement obligations of a Local Authority. The Assistant Scientist shall operate under the direction of and report to the Senior Executive Engineer and must undertake those duties as assigned to them by their Supervisor. The Assistant Scientist shall also report to the Senior Engineer and Director of Services of the section to which they are assigned or any other person designated by the Director of Services. The role requires flexibility in terms of working hours as the duties may involve working outside of normal office hours, as required. Key general duties include: • Work to enforce EU and national environmental legislation and policy with particular reference to the Waste Management Act and the Local Government (Water Pollution) Act, as amended, and related legislation; • Carry out investigations, audits and prepare reports on official complaints received from the public in respect of illegal waste or water pollution activities which may be in breach of EU and national legislation; • Appoint and manage environmental consultants and contractors carrying out Risk Assessment, Intrusive Site investigations and Environmental Sampling; • Prepare summary and indictable files for submitting to Legal Advisors and the DPP for the prosecution of offences in breach of environmental legislation. To attend District Court and Circuit Court representing Offaly County Council as expert witness for criminal proceedings; • Participate in National Working Groups relating to waste, air, noise, water quality, wastewater treatment systems, as appropriate; • To assist with profile-raising and awareness relating to waste prevention, recycling, illegal dumping, water quality issues through media and elsewhere through radio/TV interviews, press releases/articles, electronic media and talks, in line with the communications plan; • Co-ordinate the data requirements for the RMCEI plan and NEMIS system; • Carry out Health and Safety duties including toolbox talks, risk assessments, method statements and incident reporting; • Supervise staff and ensure compliance with Offaly County Councils health and safety protocols and standards; • Assist the Council’s H&S Co-ordinator in the implementation of Safety Management System; • Assist the Council’s Energy Engineer in the implementation of the Energy Management System (ISO 50,0001) as it pertains to the section. • Prepare tender requests for services and purchase of instruments and materials; • Use Technology such as Drones, Survey Equipment, Overt and Covert CCTV to detect environmental breaches; • Any other duties as may be assigned to the officer from time to time by the local authority and may include the duty of deputising for other officers of the local authority, when required, and such duties as may be assigned to them in relation to the area of any other local authority • If assigned to the Waste Enforcement section duties will include: • Assist the Waste Enforcement Team in the creation of team plans, workplans and procedures including the Recommended Minimum Criteria for Environmental Inspections (RMCEI) Plan and directions from the Regional WERLA Office; • Carry out and assess Environmental Risk Assessments of Unauthorised Waste Disposal Landfills; • Conduct site Monitoring, inspection and audits of Waste Facility Permit/Certificate of Registration Sits and preparation of reports; • Review and validate Annual Return data submitted by Waste Collection Permit Holders to the National Waste Permit Office. To liaise with the EPA, NWCPO, WERLA on priority waste collectors; • Review and validate the data provided by the Waste Facility Permit/ Certificate of Registration holders against the National Waste Permit Office returns; • Assess and examine Waste Facility Permit /Certificate of Registration applications under the Waste Management (Facility Permit and Registration) Regulations 2007; • Liaise with the National Waste Collection Permit Office in relation to permit queries and ensure waste collectors are compliant with their returns; • Monitor and inspect Development Sites to assess Construction Environmental Management Plans and Waste Management Plans; • Implement Environment legislation relating to Producer Responsibility Initiatives; • Carry out inspections and audits relating to the Landfill Levy Regulations 2002, as amended; • Carry out investigations, audits and prepare reports on official complaints received from the public in respect of Air and Noise Complaints, Waste Management (Prohibition of Waste Disposal by Burning) Regulations, Air Pollution Act 1987, Solid Fuel Regulations 2022 and the EPA Act 1992; • Contribute to the development and implementation of Air Quality Roadmaps for designated locations • Oversee the management of Civic Amenity Sites and Bring Banks owned by Offaly County Council; • Carry out investigations, audits and prepare reports on the Waste Regulations (non-exhaustive list) Commercial Food Waste Regulations, Household Food Waste Regulations, Household and Hazardous Waste, Mercury Regulations, Waste Planning, Assessment of Historic landfills; • Assist in joint road checkpoints and reports. If assigned to the Water Quality Team duties will include: • Assist the Water Quality Team in the creation of team plans, workplans and procedures including the Recommended Minimum Criteria for Environmental Inspections (RMCEI) Plan. • Carry out Statutory Septic Tank inspections under the EPA’s National Inspection Plan and use EPA Apps for uploading of Septic Tank and incident inspections; • Perform Farm inspections and cross compliance reporting of offending farms as required by the GAP Regulations and/or support GAP NAIP assigned colleagues; • Engage with farmers to identify and manage risks to water quality arising from their farming operations; • Review planning applications regarding water quality issues and compliance; • Assist with the Statutory Water Framework Directive sampling programme and ensure that it is completed to a high standard; • Perform moderate to complex sampling investigations for river assessment work and water pollution incidents. Any other duties as may be assigned to the officer from time to time by the local authority and may include the duty of deputising for other officers of the local authority, when required, and such duties as may be assigned to them in relation to the area of any other local authority. The role requires flexibility in terms of working hours as the duties may involve working outside of normal office hours. PARTICULARS OF OFFICE The Post: The post is temporary, whole-time and pensionable. A panel will be formed for an initial period of one year and this may be extended for a further year at the discretion of the Chief Executive. The panel will be used to fill appropriate vacancies that may arise for its duration. Vacancies will be offered in order of merit as per the panel. Salary: The salary shall be fully inclusive and shall be as determined from time to time. Holders of the post will be paid at the appropriate point on the salary scale in accordance with the relevant Department Circular. The rate of remuneration may be adjusted from time to time in line with Government pay. The current salary scale applicable to the post of Assistant Scientist is: €46,802 -€72,609 (LSI 2) Duties: The duties of the post are to give to the local authority, and a) such other local authorities or bodies for which the Chief Executive, for the purposes of the Local Government Acts 2001 and 2014, is Chief Executive, and b) to any other local authority or body with which an agreement has been made by the local authority, or by any of the authorities or bodies mentioned in subparagraph (a) of this paragraph under the general direction and supervision of the Chief executive or such other employee as the Chief Executive may from time to time determine, such appropriate services of an executive, administrative or management nature as may be required by any local authority or body herein before mentioned in the exercise and performance of any of its powers, functions and duties to exercise such powers, functions and duties as may be delegated to him/her by the Chief Executive from time to time, including the duty of servicing all committees that may be established by any such local authority or body. The post holder will, if required, act for an employee of a higher level. The post holder may be required to work outside his/her normal job description from time to time. Work Base: Offaly County Council reserves the right to assign you to any department or premises in use by the Council, now or in the future. Changes in location of employment will not result in payment of disturbance money or other compensation. The person appointed will be required to provide him/herself at his/her own expense with the necessary mode of travel to and from work. Working Hours: The working hours at present provide for a five day, thirty-five hours working week, hours may vary from time to time. The working hours may be reviewed at any time by the Council. The post may require flexibility in working outside of normal hours, including at weekends, as necessary. No additional remuneration will be paid in respect of such activities. Granting of annual leave, payment for annual leave and arrangement for public holidays will be governed by the provisions of the Organisation of Working Time Act, 1997 (as amended) Sick Leave: The terms of the Public Service Management (Sick Leave) Regulations 2014 as amended will prevail. Probation: Appointees will be on probation for the first year of employment. The terms of the Offaly County Council Probation Policy will apply. Superannuation: Public Service Pensions (Single Scheme and Other Provisions) Act 2012: New members joining the Public Sector on or after 1st January, 2013 will be required to join the Single Public Service Pension Scheme. The Single Scheme applies to all pensionable first-time entrants to the Public Service as well as to former public servants returning to the public service after a break of more than 26 weeks. A rate of PRSI contribution will be required of their superannuation to contribute to the local authority at the rate of 3% of their pensionable remuneration plus 3.5%, of net pensionable remuneration (i.e. pensionable remuneration less twice the annual rate of social insurance old age contributory pension payable at the maximum rate to a person with no adult dependant or qualified children). This includes a contribution to a Spouse’s and Children’s Scheme. Pension and retirement lump sum based on career-average pay, pensions will be co-ordinated with the State Pension Contributory (SPC). For persons who commenced public sector employment prior to 1st January 2013: Persons who become pensionable employees of a local authority who are liable to pay the Class A rate of PRSI contribution will be required in respect of their superannuation to contribute to the local authority at the rate of 1.5% of their pensionable remuneration plus 3.5% of net pensionable remuneration (ie. pensionable remuneration less twice the annual rate of social insurance old age contributory pension payable at the maximum rate to a person with no adult dependent or qualified children). All persons who become pensionable employees of a local authority will be required in respect of the Local Government (Spouses and Childrens Contributory Pension) Scheme to contribute to the local authority at the rate of 1.5% of their pensionable remuneration in accordance with the terms of the scheme. Retirement: Public Service Pensions (Single Scheme and Other Provisions) Act 2012: The compulsory retirement age for new entrants as defined by the Public Service Pensions (Single Scheme and Other Provisions) Act 2012 is 70 years. Minimum pension age of 66 years, rising to 67 years and 68 years in line with State Pension age changes, is applicable. Public Service Superannuation (Miscellaneous Provisions) Act, 2004: There is no mandatory retirement age for ‘New Entrants’ from 1st April, 2004 to the public service as defined in the Public Service Superannuation (Miscellaneous Provisions) Act 2004. 65 years is the minimum age at which a person may be paid. As a new entrant to the public service, under the terms of this legislation, new entrants will not be required to retire on grounds of age. Anyone who is not a ‘New Entrant’ to the public service, defined in the Public Service Superannuation (Miscellaneous Provisions) Act 2004 is subject to compulsory retirement age of 65 years. An Assistant Staff Officer is the second grade in a five tier administrative structure within Offaly County Council ranging from the most common entry grade of Clerical Officer, the tier below the Assistant Staff Officer post, through to Staff Officer, Senior Staff Officer and Administrative Officer which are generally line management roles. The Assistant Staff Officer can therefore be an entry grade for candidates meeting the qualification requirements as well as providing a promotional opportunity for serving Clerical Officers who meet the specified competencies and requirements of the post. An Assistant Staff Officer works as part of a multi-disciplinary team within one of the previously outlined Local Authority Directorates, to provide administrative support and customer service across the broad range of local authority front line and internal services which includes for example corporate, finance, IT and human resource functions. Front line services include social housing; transportation infrastructure; environmental protection; water, wastewater, recreation, amenity and cultural services such as the arts and public library service.  Local Authorities also play a key role in supporting economic development and enterprise promotion at local level. An Assistant Staff Officer will generally work under the direction and management of a Staff Officer, Senior Staff Officer or Administrative Officer and may from time to time, be required to deputise for a Staff Officer, the first level of line management within the administrative grades. The order of candidates placed on each of the three panels is determined by where they were placed on the overall Order of Merit List. Confined Competition (Panels A and C as appropriate) (iv) (a) be a serving employee of a local authority or a regional assembly and have not less than two years’ satisfactory experience in a post of Clerical Officer or analogous post. For persons who commenced public sector employment prior to 1st January 2013: Persons who become pensionable employees of a local authority who are liable to pay the Class A rate of PRSI contribution will be required in respect of their superannuation to contribute to the local authority at the rate of 1.5% of their pensionable remuneration plus 3.5% of net pensionable remuneration (ie. pensionable remuneration less twice the annual rate of social insurance old age contributory pension payable at the maximum rate to a person with no adult dependent or qualified children). Persons who become pensionable employees of a local authority who are liable to pay the Class D rate of PRSI contribution will be required in respect of their superannuation to contribute to the local authority at the rate of 5% of their pensionable remuneration. All persons who become pensionable employees of a local authority will be required in respect of the Local Government (Spouses and Childrens Contributory Pension) Scheme to contribute to the local authority at the rate of 1.5% of their pensionable remuneration in accordance with the terms of the scheme. 10. Retirement: Public Service Pensions (Single Scheme and Other Provisions) Act 2012: The compulsory retirement age for new entrants as defined by the Public Service Pensions (Single Scheme and Other Provisions) Act 2012 is 70 years. Minimum pension age of 66 years, rising to 67 years and 68 years in line with State Pension age changes, is applicable. Public Service Superannuation (Miscellaneous Provisions) Act, 2004: There is no mandatory retirement age for ‘New Entrants’ from 1st April, 2004 to the public service as defined in the Public Service Superannuation (Miscellaneous Provisions) Act 2004. 65 years is the minimum age at which a person may be paid. As a new entrant to the public service, under the terms of this legislation, new entrants will not be required to retire on grounds of age. Anyone who is not a ‘New Entrant’ to the public service, defined in the Public Service Superannuation (Miscellaneous Provisions) Act 2004 is subject to compulsory retirement age of 65 years. Should additional hours be required, time in lieu procedures will apply. d.       Place of Work The Education Officer is a remote role with substantial travel involved. A company vehicle will be provided. Water Safety Ireland’s head office is currently located on the Long Walk, Galway City. The office will be your designated place of work from time to time,to meet the needs of the organisation and the head office itself could relocate during the contract to facilitate business needs. When absent from home and office on duty, appropriate travelling expenses and subsistence allowances will be paid subject to the normal Civil or Public Service regulations. e.       Company Vehicle and Travel As part of our commitment to supporting Regional Education Officers, a company vehicle will be provided for work-related use. Travel expenses incurred during official duties will be reimbursed in accordance with the Public Service travel and subsistence policy. f.         Tenure and Position The position of Clerical Officer – Regional Education Officer is a full-time role being offered initially on a 3-year fixed term. The provisions of the Unfair Dismissals Acts 1977 – 2007 will not apply to the termination of the contract consisting only of the expiry of the fixed term. The first year will serve as a probationary period, during which the appointee’s performance and suitability for the role will be formally assessed. If, during this time, it becomes evident that the role is not a good fit, the contract may be concluded early. Upon successful completion of this probation period, the appointee will continue under the terms of the remaining contract. At the end of the three-year term, and subject to satisfactory performance, the role may be extended or transitioned to one of indefinite duration. The probationary contract will be for a period of 12 months; this is included and not additional to the specified purpose contract. Notwithstanding this paragraph and the paragraph immediately following below, this will not preclude an extension of the probationary contract in appropriate circumstances. During the period of your probationary contract, your performance will be subject to review by your supervisor(s) to determine whether you: (i)                Have performed in a satisfactory manner, (ii)              Have been satisfactory in general conduct, and (iii)            Are suitable from the point of view of health with regard to sick leave. g.       Suspension of Probation WSI may suspend the probationary period and, as a result, extend the term of the probationary contract in the following circumstances:                                            i.     the probationary period will be suspended if the officer is on Maternity or Adoptive leave,                                           ii.     the probationary period may, at the discretion of the Department, be suspended where the employee is absent on any other form of statutory or non-statutory leave. Where WSI’s ability to assess the officer and/or the officer’s ability to demonstrate their suitability for permanent appointment is compromised by the officer’s absence on leave, the contract period will be extended by the period of leave taken. h.       Duties The appointee will be required to perform any duties appropriate to their grade which may be assigned to them. They may not engage in private practice or be connected with any outside business which would interfere with the performance of official duties. i.         Sick Leave Pay during properly certified sick absence, provided there is no evidence of permanent disability for service, will apply on a pro-rata basis, in accordance with the provisions of the sick leave circulars. Officers who will be paying Class A rate of PRSI will be required to sign a mandate authorising the Department of Employment Affairs and Social Protection to pay any benefits due under the Social Welfare Acts directly to the employing Department or Organisation. Payment during illness will be subject to the officer making the necessary claims for social insurance benefit to the Department of Employment Affairs and Social Protection within the required time limits. j.         Superannuation and Retirement The appointee will be offered public service pension terms and retirement age conditions in accordance with pension arrangements in the WSI depending on the status of the successful appointee: In general, an appointee who has never worked in the Public Service will be offered appointment based on membership of the Single Public Service Pension Scheme (“Single Scheme”). Full details of the Scheme are at www.singlepensionscheme.gov.ie . Where the appointee has worked in a pensionable (non-Single Scheme terms) public service job in the 26 weeks prior to appointment or is currently on a career break or special leave with/without pay, different terms may apply. The pension entitlement of such appointees will be established in the context of their public service employment history. Key provisions attached to membership of the Single Scheme are as follows: (a)    Pensionable Age: The minimum age at which pension is currently payable is 66 (this is under review and will rise in line with changes in State Pension age). (b)    Retirement Age: Scheme members must retire on reaching the age of 70. (c)     Career average earnings are used to calculate benefits (a pension and lump sum amount accrue each year and are uprated each year by reference to CPI). (d)    Post retirement pension increases are linked to CPI. (e)    An individual who is on secondment will remain a member of the parent organisation’s pension scheme and the pensionable remuneration will be based on their substantive grade i.e., the grade at which the individual is employed in their parent organisation. (f)       An individual who was a member of a “preexisting public service pension scheme” as construed by the Public Service Pensions (Single Scheme and Other Provisions) Act 2012 and who does not qualify for membership of the Single Scheme will have standard public service pension terms reflecting new entrant or nonnew entrant status for the purposes of the Public Service Superannuation (Miscellaneous Provisions) Act 2004. k.           Pension Abatement If the appointee has previously been employed in the Civil or Public Service and is in receipt of a pension from the Civil or Public Service or where a Civil/Public Service pension comes into payment during their re-employment that pension will be subject to abatement in accordance with Section 52 of the Public Service Pensions (Single Scheme and Other Provisions) Act 2012. Please note: In applying for this position, you are acknowledging that you understand that the abatement provisions, where relevant, will apply. It is not envisaged that the employing Department/Office will support an application for an abatement waiver in respect of appointments to this position. However, if the appointee was previously employed in the Civil or Public Service and awarded a pension under voluntary early retirement arrangements (other than the Incentivised Scheme of Early Retirement (ISER), the Department of Health Circular 7/2010 VER/VRS or the Department of Environment, Community & Local Government Circular letter LG(P) 06/2013, any of which renders a person ineligible for the competition) the entitlement to that pension will cease with effect from the date of reappointment. Special arrangements may, however, be made for the reckoning of previous service given by the appointee for the purpose of any future superannuation award for which the appointee may be eligible. l.             Ill Health Retirement Please note that where an individual has retired from a Civil/Public Service body on the grounds of ill health their pension from that employment may be subject to review in accordance with the rules of ill-health retirement within the pension scheme of that employment. Applicants will be required to attend an appointed medical professional to assess their ability to provide regular and effective service taking account of the condition which qualified them for IHR. Appointment post ill health retirement from Civil Service If successful in their application through the competition, the applicant should be aware of the following: If deemed fit to provide regular and effective service and assigned to a post, their civil service ill health pension ceases. If the applicant subsequently fails to complete probation or decides to leave their assigned post, there can be no reversion to the civil service IHR status, nor reinstatement of the civil service IHRpension, that existed prior to the application nor is there an entitlement to same.                  i.     The applicant will become a member of the Single Public Service Pension Scheme (SPSPS) upon appointment if they have had a break in pensionable public/civil service of more than 26 weeks. Appointment post Ill health retirement from public service:                 ii.     Where an individual has retired from a public service body their ill-health pension from that employment may be subject to review in accordance with the rules of ill-health retirement under that scheme.               iii.      If an applicant is successful, on appointment the applicant will be required to declare whether they are in receipt of a public service pension (ill-health or otherwise) and their public service pension may be subject to abatement.               iv.      The applicant will become a member of the Single Public Service Pension Scheme (SPSPS) upon appointment if they have had a break in pensionable public/civil service of more than 26 weeks.
