PARTICULARS OF THE POSITION 1. The office is wholetime, permanent and pensionable. 2. WAGES – HOURLY RATE: €17.38; €17.59; €17.61; €17.66; €17.73; €17.77; €17.83; €17.90; €17.98; €18.06 Rates as at 1st March 2025. An eating on site and travel allowance will also be applicable. Entry point to this scale will be determined in accordance with Circulars issued by the Department Housing, Planning and Local Government. In accordance with Departmental Circular letter EL 02/2011, a person who is not a serving local authority employee on or after 1st January 2011, will enter the scale for the position at the minimum point. Rate of remuneration may be adjusted from time to time in line with Government Policy. The salary shall be fully inclusive and shall be as determined from time to time. Holders of the office shall pay to the Local Authority any fees or other monies (other than their inclusive salary) payable to or received by them by virtue of their office or in respect of any services, which they are required by or under any enactment to perform. 3. UNIFORM/PERSONAL PROTECTIVE EQUIPMENT (PPE): As a condition of employment, the holder of the post will be required, at all times when on duty, to wear such uniform and /or items of personal protective equipment as are specified from time to time by Dun Laoghaire Rathdown County Council. 4. SUPERANNUATION CONTRIBUTION: Persons who become pensionable officers of a Local Authority who are liable to pay the Class A rate of PRSI contribution will be required in respect of their superannuation to contribute to the Local Authority at the rate of 1.5% of their pensionable remuneration plus 3.5% of net pensionable remuneration (i.e. pensionable remuneration less twice the annual rate of social insurance old age contributory pension payable at the maximum rate to a person with no adult dependent or qualified children). Persons who become pensionable officers of a Local Authority who are liable to pay the Class D rate of PRSI contribution will be required in respect of their superannuation to contribute to the Local Authority at the rate of 5% of their pensionable remuneration. All persons who become pensionable officers of a Local Authority will be required in respect of the Spouses and Children’s Contributory Pension Scheme to contribute to the Local Authority at the rate of 1.5% of their pensionable remuneration in accordance with the terms of the scheme. RETIREMENT: New Entrants recruited to the Public Service on or after 1 January 2013 Pensionable public servants (new joiners) recruited to the Public Service for the first time on or after 1 January 2013 (the commencement date of the Single Scheme) will be members of the Public Service Pensions (Single Scheme and Other Provisions) Act 2012. Pension age Minimum pension age is linked to the State Pension age which is currently 66 but may be subject to change. Compulsory retirement age Scheme members must retire at the age of 70. In all other cases, staff recruited on or after 1 January 2013 who were employed in the Public Service on 31 December 2012 or within a period prior to 31 December 2012 not exceeding 26 weeks will retain their existing pension scheme terms and conditions. In certain circumstances, e.g. where the public servant was on secondment or approved leave or remains on the same contract of employment, the 26-week rule does not apply. Incentivised Scheme for Early Retirement (ISER) It is a condition of the Incentivised Scheme for Early Retirement (ISER) as set out in Department Finance Circular 12/09 that retirees, under that Scheme, are debarred from applying for another position in the same employment or the same sector. Therefore, such retirees may not apply for this position. 5. PROBATION When a person is not already a permanent officer of a Local Authority within the public service Ireland and is appointed to a permanent office the following provisions shall apply, that is to say:- a. There shall be a period after such appointment takes effect during which such person shall hold office on probation; b. Such period shall be one year; c. Such person shall cease to hold such office at the end of the period of probation unless, during such period, the Chief Executive has certified that the service of such person in such office is satisfactory. 6. HOURS OF WORK Applicants will be required to work a 39-hour week, Monday to Friday (08:00 – 16:30 Monday to Thursday; 08:00 – 15:30 on Friday), or other hours specified by management AND will be required to work overtime as required including Saturdays, Sundays, and Public Holidays for which payment at the appropriate rate will be made. 7. ANNUAL LEAVE Annual leave entitlement for the position of Driver is 24 days per annum in accordance with Department of Environment, Community and Local Government Circular LG(P) 07/2011. Prior authorisation is essential before annual leave is taken. The granting of annual leave at any particular time is always subject to the requirements of the council and all annual leave is liable to suspension during periods of exceptional pressure. The final decision in allocating leave rests with Management. 8. DUTIES: The post holder will be required to carry out all the duties allocated to them by the Council under the direction and supervision of the relevant Supervisor, which will include but are not limited to: a. Driving a lorry/van or any Council vehicle (as assigned) and carrying out General Operative duties; b. Operate additional vehicles/plant in order to meet the future operational needs of Dun Laoghaire Rathdown County Council e.g. mini excavator (training will be provided). c. Carrying out General Operative duties within the crew; d. General maintenance of the vehicle (including washing, fuelling, wheel replacement and so on) on a regular basis, or as required; e. Carry out daily vehicle checks as per Road Safety Authority (Commercial Vehicle Roadworthiness) (Vehicle Maintenance and Repair regulations 2013); f. Have due regard to Health, Safety and Welfare at Work legislation; g. Loading of vehicles and operation of any lifting equipment and so on; h. Operating equipment, tools and machinery as required; i. Assuming personal responsibility for own safety at work; j. Working collaboratively with other staff; k. Operate existing technology and any new technology that may be introduced in the future and recording daily operations on such systems (for example vehicle log book data entry or daily vehicle check via smartphone or tablet, or the Proworks Health and Safety Application); l. Keeping records relating to their duties as directed by the supervisory staff; m. Dealing effectively and courteously with customers n. Comply with all Council policies and procedures in all aspects of their work with/on behalf of the Council, including but not limited to Dun Laoghaire Rathdown County Council’s Driver Handbook; o. Ensure that all vehicles are securely parked up in the relevant works depot at the end of each working day and where procedures exist in relation to key boxes/lockers, such procedures are to be adhered to. p. Carry out duties appropriate to the grades of Driver and General Operative, and any other duties that may be assigned from time to time; q. On assignment, they will be required to carry out all the duties allocated to them by the Council through its Supervisory Staff within the service department/section of appointment and as applicable to the grade of Driver. This may include but is not limited to activities pertaining to the delivery of services across the Council’s various Departments. r. Submit motor claim accident reports to the Machinery Yard Engineer within 24 hours of any incident occurring; s. Maintain a vehicle log book, recording details of all journeys undertaken by the vehicle they are driving; t. Ensure qualifications such as CPC courses, Health and Safety courses, Safe Pass and other training skills are updated as required; u. The post holder may be assigned to any Directorate or work location, from time to time, as determined by Management. The particular duties and responsibilities attached to the post may vary from time to time, without changing the general character of the duties or level of responsibilities entailed. The post holder may therefore be required to perform duties appropriate to the post, other than those detailed above, and to take instructions from and report to, an appropriate Officer or such designated Officer as may be assigned from time to time by the Council. The duties of the post are to give to the local authority and to (a) The local authorities or bodies for which the Chief Executive is Chief Executive, and (b) To any other local authority or body with which an agreement has been made by the local authority or by any of the authorities or bodies referred to in sub-paragraph (a) of this paragraph under the general direction and control of the Chief Executive or of such officers as the Chief Executive may from time to time determine, such appropriate computing, technical, management, administrative, executive, supervisory, advisory andancillary services as may be required by any local authority or body hereinbefore mentioned in the exercise and performance of any of its powers, functions and duties and to exercise such powers, functions and duties as may be delegated to him or her by the Chief Executive from time to time including the duty of servicing all committees that may be established by any such local authority or body. The holder of the post will, if required, act for an officer of a higher level. 9. LOCATION & RESIDENCE Holders of the office shall reside in the district in which their duties are to be performed or within a reasonable distance thereof. Dun Laoghaire-Rathdown County Council reserves the right to assign Employees to any premises in use by the Council, now or in the future subject to reasonable notice. 10. RECRUITMENT: Pursuant to article 8 of the Local Government (Appointment of Officers) Regulation, 1974, the Minister has given directions as follows: i. Water Safety Ireland is seeking 3 dedicated and enthusiastic Regional Education Officers to join our education team. As a Regional Education Officer, you will play a pivotal role in delivering our water safety and drowning prevention programmes. Your responsibilities will include conducting educational sessions and workshops in early learning centres, schools, colleges, corporate entities and other various public and private organisations within your designated region and online. Occasionally, you may be required to deliver sessions outside of your region if needed. Additionally, you will be expected to host online sessions as required, ensuring a broad and impactful engagement. Your primary mission will be to ensure that our programmes are effectively delivered, remain relevant, and achieve significant impact, in alignment with Water Safety Ireland’s national goals of reducing drownings and enhancing community safety. You will report directly to the Education Manager, contributing to the overall success of our educational initiatives. Blended: This role is primarily remote with a significant amount of travel involved, including some outside of your designated region, and a requirement to attend meetings in the office for induction and training and work-related matters. Training will be in the office for the first week, and then as required. The successful candidate will be required to work such additional hours from time to time as may be reasonable and necessary for the proper performance of their duties, subject to the limits set in the working time regulations. Should additional hours be required, time in lieu procedures will apply. d. Place of Work The Education Officer is a remote role with substantial travel involved. A company vehicle will be provided. Water Safety Ireland’s head office is currently located on the Long Walk, Galway City. The office will be your designated place of work from time to time,to meet the needs of the organisation and the head office itself could relocate during the contract to facilitate business needs. When absent from home and office on duty, appropriate travelling expenses and subsistence allowances will be paid subject to the normal Civil or Public Service regulations. e. Company Vehicle and Travel As part of our commitment to supporting Regional Education Officers, a company vehicle will be provided for work-related use. Tenure and Position The position of Clerical Officer – Regional Education Officer is a full-time role being offered initially on a 3-year fixed term. The provisions of the Unfair Dismissals Acts 1977 – 2007 will not apply to the termination of the contract consisting only of the expiry of the fixed term. The first year will serve as a probationary period, during which the appointee’s performance and suitability for the role will be formally assessed. If, during this time, it becomes evident that the role is not a good fit, the contract may be concluded early. Upon successful completion of this probation period, the appointee will continue under the terms of the remaining contract. At the end of the three-year term, and subject to satisfactory performance, the role may be extended or transitioned to one of indefinite duration. The probationary contract will be for a period of 12 months; this is included and not additional to the specified purpose contract. Notwithstanding this paragraph and the paragraph immediately following below, this will not preclude an extension of the probationary contract in appropriate circumstances. During the period of your probationary contract, your performance will be subject to review by your supervisor(s) to determine whether you: (i) Have performed in a satisfactory manner, (ii) Have been satisfactory in general conduct, and (iii) Are suitable from the point of view of health with regard to sick leave. g. Suspension of Probation WSI may suspend the probationary period and, as a result, extend the term of the probationary contract in the following circumstances: i. the probationary period will be suspended if the officer is on Maternity or Adoptive leave, ii. the probationary period may, at the discretion of the Department, be suspended where the employee is absent on any other form of statutory or non-statutory leave. Where WSI’s ability to assess the officer and/or the officer’s ability to demonstrate their suitability for permanent appointment is compromised by the officer’s absence on leave, the contract period will be extended by the period of leave taken. h. Duties The appointee will be required to perform any duties appropriate to their grade which may be assigned to them. They may not engage in private practice or be connected with any outside business which would interfere with the performance of official duties. i. Sick Leave Pay during properly certified sick absence, provided there is no evidence of permanent disability for service, will apply on a pro-rata basis, in accordance with the provisions of the sick leave circulars. Officers who will be paying Class A rate of PRSI will be required to sign a mandate authorising the Department of Employment Affairs and Social Protection to pay any benefits due under the Social Welfare Acts directly to the employing Department or Organisation. Payment during illness will be subject to the officer making the necessary claims for social insurance benefit to the Department of Employment Affairs and Social Protection within the required time limits. j. Superannuation and Retirement The appointee will be offered public service pension terms and retirement age conditions in accordance with pension arrangements in the WSI depending on the status of the successful appointee: In general, an appointee who has never worked in the Public Service will be offered appointment based on membership of the Single Public Service Pension Scheme (“Single Scheme”). Full details of the Scheme are at www.singlepensionscheme.gov.ie . Where the appointee has worked in a pensionable (non-Single Scheme terms) public service job in the 26 weeks prior to appointment or is currently on a career break or special leave with/without pay, different terms may apply. The pension entitlement of such appointees will be established in the context of their public service employment history. Key provisions attached to membership of the Single Scheme are as follows: (a) Pensionable Age: The minimum age at which pension is currently payable is 66 (this is under review and will rise in line with changes in State Pension age). (b) Retirement Age: Scheme members must retire on reaching the age of 70. (c) Career average earnings are used to calculate benefits (a pension and lump sum amount accrue each year and are uprated each year by reference to CPI). (d) Post retirement pension increases are linked to CPI. (e) An individual who is on secondment will remain a member of the parent organisation’s pension scheme and the pensionable remuneration will be based on their substantive grade i.e., the grade at which the individual is employed in their parent organisation. (f) An individual who was a member of a “preexisting public service pension scheme” as construed by the Public Service Pensions (Single Scheme and Other Provisions) Act 2012 and who does not qualify for membership of the Single Scheme will have standard public service pension terms reflecting new entrant or nonnew entrant status for the purposes of the Public Service Superannuation (Miscellaneous Provisions) Act 2004. k. Pension Abatement If the appointee has previously been employed in the Civil or Public Service and is in receipt of a pension from the Civil or Public Service or where a Civil/Public Service pension comes into payment during their re-employment that pension will be subject to abatement in accordance with Section 52 of the Public Service Pensions (Single Scheme and Other Provisions) Act 2012. It is not envisaged that the employing Department/Office will support an application for an abatement waiver in respect of appointments to this position. The Role of the Complaints & Resolutions Officer: The Complaints & Resolutions Officer isrequired to deliver impartial and independent analysis and decision making in complaints relating to legal practitioners. The Complaints & Resolutions Officer is also required to advise senior management in respect of their areas of responsibility and may be called upon to represent the organisation to external stakeholders. The Complaints & Resolutions Officers may be deployed as Inspectors and/or Case Managers.
