Grade VI Data Protection Breach Compliance Officer

Job Summary The Child and Family Agency was established on 1st January 2014 and is responsible for a range of statutory functions including provision of child protection, alternative care, specified regulatory services and a range of family support services. The Agency has commenced a major improvement programme with significant focus on Practice, Culture and Structure. The Agency currently has responsibility for a budget of circa €1.2billion and delivers its services through over 5,500 people in 259 locations across the Country. The Child and Family Agency has responsibility for the following range of services: • Child Protection and Welfare • Parenting, Family Support and Early Help Services • Alternative Care • Birth Information & Tracing and Adoption • Tusla Education Support Services (TESS) • Children’s Service Regulation • Counselling and Therapeutic Supports Further information is available on www.tusla.ie Data Protection Unit (DPU) Tusla processes a large volume of highly sensitive personal data on a daily basis in order to deliver the critical services it provides to Children and Families across the State. In doing this, Tusla must ensure that it has adequate organisational and technical measures in place; that the rights and freedoms of Tusla service users are respected and that privacy risks to those rights and freedoms are minimised; and that a fit for purpose operating model for Data Protection and Freedom of Information (FOI) and is implemented. Tusla’s DPU was mobilised in 2018. Alongside the appointment of a Data Protection Officer (DPO), a General Data Protection Regulation (GDPR) requirement, the DPU provides data protection and freedom of information support and guidance to all staff. Key DPU functions include: • Data Protection Operations, including data subject requests; personal data breach management; the data protection helpdesk, and the Privacy Officer Network, • Data Protection Compliance, • Data Protection and Privacy Advice, and • Freedom of Information Compliance Job Objectives Main Duties and Responsibilities: • Screen and assess reported data security incidents. • Determine the relevant and appropriate follow-up information to be requested in response to a reported data security incident. • Apply data protection legislation to examine incident details gathered and determine whether the conditions are met to confirm a personal data breach. • Apply relevant criteria to assess whether the risk resulting from confirmed data breaches meets the respective statutory risk thresholds requiring breach notification to the Data Protection Commission and to relevant affected persons. • Determine and advise appropriate breach containment and recovery actions. • Prepare incident reports for notifying qualifying personal data breaches to the Data Protection Commission. • Prepare information to assist with notifying qualifying personal data breaches to relevant affected persons. • Arranging for timely responses to be issued to follow-on queries from the Data Protection Commission regarding notified data breaches. • Identifying deficiencies/weaknesses in organisational/technical data security measures that led to data breaches and advising recommendations to minimise the risk of similar type data breaches recurring. • Replying to data security/data breach related helpdesk/phone queries from staff and service users. • Creating and updating a file record documenting the management of each data security incident received. • Completing entries in and maintaining the Breach Register • Compiling management information reports of statistical information highlighting data breach themes, patterns and trends as indicators of data protection compliance standards. • Observing respect, consideration and confidentiality for all stakeholders. • Discharging duties using clear and effective communications. • Any other duties assigned by the line manager. Health & Safety • Comply with and contribute to the development of policies, procedures, guidelines and safe professional practice and adhere to relevant legislation, regulations and standards. • Have a working knowledge of the Health Information and Quality Authority (HIQA) Standards as they apply to the service for example National Standards for Child Protection and Care and comply with associated Tusla – Child and Family Agency protocols for implementing and maintaining these standards as appropriate to the role. • To support, promote and actively participate in sustainable energy, water and waste initiatives to create a more sustainable, low carbon and efficient health service.
